1. Agreement to Terms

By accessing and using the Vinyl Mixtape Shop website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

• Attempt to reverse engineer any software contained on the website
• Remove any copyright or other proprietary notations from the materials

3. Products and Services

All products offered through our Service are custom-made to order. By placing an order, you acknowledge that:

• Products are personalized and non-refundable except as outlined in our Return Policy
• Production times may vary based on demand
• Color representation on screens may vary from the final printed product
• Lathe-cut vinyl records have unique characteristics that differ from pressed records
• We reserve the right to limit the quantities of any products or services we offer
• Product availability is subject to change without notice

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

4. Accuracy of Information

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete, or more timely sources of information.

This site may contain certain historical information. Historical information is not necessarily current and is provided for your reference only. We reserve the right to modify the contents of this site at any time.

4A. Intellectual Property Rights

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all content you upload to create your custom vinyl records.

You agree not to upload content that:

• Infringes on any third party's copyright, trademark, or other intellectual property rights
• Violates any law or regulation
• Is defamatory, obscene, pornographic, or offensive
• Contains viruses or other harmful code

5. User Accounts and Billing Information

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

6. Pricing and Payment

All prices are listed in US dollars and are subject to change at any time without notice. We reserve the right to modify pricing, promotions, and product offerings at our sole discretion. Payment must be received in full before production begins. We accept payment through our secure Shopify checkout system.

7. Right to Refuse Service

We reserve the right to refuse or cancel service to anyone for any reason at any time, including but not limited to violations of these Terms, suspected fraudulent activity, or content that we determine to be inappropriate or infringing on third-party rights. In the event of order cancellation, any payments received will be refunded.

A breach or violation of any of the Terms will result in an immediate termination of your account and your right to use the Service.

8. Shipping and Delivery

Shipping times are estimates and not guaranteed. Vinyl Mixtape Shop is not responsible for delays caused by shipping carriers, weather, customs, or other factors outside our control.

9. Privacy and Security

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

We cannot guarantee that your submissions, content, or personal information will be completely secure during transmission over the Internet. Any transmission of such information is at your own risk. While we implement reasonable security measures, we are not responsible for circumvention of any privacy settings or security measures contained on the Service.

9A. Prohibited Uses

You agree not to use the Service or our website for any of the following purposes:

Violation of these prohibited uses may result in immediate termination of your access to the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VINYL MIXTAPE SHOP EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that:

• The Service will meet your requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of the Service will be accurate or reliable
• The quality of any products, services, information, or other material obtained through the Service will meet your expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VINYL MIXTAPE SHOP, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Vinyl Mixtape Shop and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Service or your use of the Service.

13. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. Upon termination, your right to use the Service will immediately cease.

13A. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, represent the complete agreement between you and Vinyl Mixtape Shop regarding your use of the Service. This agreement replaces and supersedes all previous agreements, whether written or verbal, including earlier versions of these Terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

16A. Waiver and Assignment

If we do not immediately enforce a provision of these Terms, it does not mean we are waiving our right to enforce it later. You may not transfer or assign your rights under these Terms to any other party. We reserve the right to transfer or assign our rights and obligations under these Terms at our discretion.
